This website is presented to you by Groovy Parachute, a business founded in Delaware, USA.

Throughout this agreement, "we", "us", "our", "Groovy" refer to Groovy Parachute. We offer this "site", including but not limited to tools, products, text, hyperlinks, collectively the "content" to you, the "user" or "customer", as the case may be.

By visiting our site, following a link, downloading any part, utilising a tool, by purchasing a product or subscription from us, you engage in our service and agree to our terms and conditions, our "Terms of Service", or "terms", as we hereby state.

We reserve the right to change any part of these terms, at any time.

1. Environment & sustainability

  • We believe every shipment makes a difference. That's why we choose Gelato to fulfil your orders. Founded in Oslo in 2012, we believe Gelato have sustainability as mission, with 85% of orders produced in the customer's country. Empowering us all to reduce the impact of international shipping on the biosphere of Earth.
  • Streamlining commerce by producing at a factory closer to you, print on demand (POD) also creates opportunity for people in your region. Producing for you with materials sourced in a responsible way. In accordance with safety regulations.
  • However, while encouraging this philosophy, we cannot be held liable for a shortfall of sustainability or any environmental impact, perceived or real, anywhere in the supply chain.

2. Personal data

  • We don't store any payment data in our systems, including but not limited to card numbers, PIN codes, and cryptographic ciphers. These are handled by our payments provider, certified at the highest level of security, PCI Level 1.
  • On placing an order via our Shop or subscribing to AI Pilot the checkout requires input of data essential for our service to you. You may register (create a "login" or "user profile") and should you elect to, we request you to provide at least a user ID, password, and working email.
  • For safety reasons every conversation in AI Pilot requires a unique identifier (ID), which we encrypt, with no association to the user's credentials at the AI provider.
  • On registration, we store in our systems such personal data as you provide, with all passwords encrypted. When utilising a feature requiring a login, we store on your user profile the data essential to operate such features, excluding financial data, expressly for your future use. Although we make every effort to secure our databases, servers, programmatic interfaces ("API" functions) with private communication (TLS and HTTPS) and two-factor authentication (TFA) for administrator access, we make no warranty of any kind and accept no liability for claims around the privacy of data.
  • You agree to protect your login and accept responsibility for activities on your account, neither divulging nor publicising, by accident or otherwise, any information you’ve provided for your login with Groovy.

3. Cookies & General Data Protection Regulation (GDPR)

  • In promoting our service to you, we utilise Google Analytics 4 with Basic Consent Mode.
  • Our systems do not transmit any data to Google until you grant permission via the consent banner, designed to prompt you on first visit to our site.
  • You have the possibility to change your consent choice via our User Settings page at any time. However should the consent banner not prompt you, or malfunction in any way, whether due to a software fault or any other reason, we shall not be held liable for such.

4. SMS Privacy policy

For text massaging, we may disclose Personal Data or relevant information, only as follows:

  • Service Providers: companies who help us deliver the Messaging Service; we will not share your opt-in to an SMS short code campaign with a third party for any purposes unrelated to supporting you in such a campaign. We may share your Personal Data with third parties who help us provide the service, including, but not limited to platform providers, phone companies, and vendors who assist in delivery of text messages.
  • Affiliates: we may disclose relevant Personal Data to our affiliates or subsidiaries; however, if we do, their use and disclosure of your Personal Data will be subject to this Policy.
  • The above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

5. Purchase agreements

We enter into a purchase agreement when you acknowledge I ACCEPT THE TERMS OF SERVICE to complete the checkout by placing an order.

6. Deliveries

  • During checkout we compute the price of shipping for the goods you're ordering.
  • On checkout success, likewise on our Order Status page, we quote an estimated time of arrival ("ETA") for the goods you’ve purchased. However, such delivery times are planned values, subject to delays in manufacturing or transit, e.g. longer than expected lead times from shipping handlers (courier or postal). We cannot accept any liability for delivery times, whether quoted erroneously on the website, unexpected delays, or any other reason.
  • Once you receive a parcel, the responsibility is yours to verify the condition of all products, the information on the bill of delivery, and to inform us should you require anything in addition from us.
  • We shall not be liable for any damage or loss incurred by reason of any acts or omissions of the deliverer, our supply chain partners, their directors, employees, sub-contractors, agents, representatives and/or affiliates.

7. Returns & refunds

  • We manufacture each item to order, at a factory as close as possible to you. We do not hold any stock, therefore we are unable to cater for, neither do we accept liability for "try before you buy" orders.
  • However, we would love you to be 100% satisfied as a customer. For any concerns, please get in touch via support@groovyparachute.com and at our discretion, we will replace or refund (as you prefer) any damaged or unsatisfactory goods within 30 days of delivery. In case of damage or quality issues, please include a picture, plus a description.
  • Although we cannot be held liable for refunds or damages of any kind beyond 30 days from delivery, we consider every situation, so please write to us.

8. Prices, taxes, delivery costs

  • At checkout we make all reasonable efforts to charge to your elected payment method the prices as shown on the site. However, should errors occur due to a system fault or otherwise, causing any items to be charged at incorrect prices, we shall not be obliged to sell products at lower prices. Hereby you agree to pay any shortfall in price at checkout. Whether the goods are in process, manufacturing, or delivery. Likewise we agree to refund any money you’ve paid in excess of our correct price, at time of placing the order.
  • We compute the sub total, cost of delivery, applicable taxes and grand total at checkout, which we indicate in a Checkout Summary prior to payment.
  • Unless we state otherwise, prices on our product pages exclude Sales Tax or Value Added Tax ("VAT"), as the case may be in your region. At checkout, our systems communicate online with our payments provider (PCI compliant, Level 1) to calculate taxes, as applicable in your region. We present such additional costs in a Checkout Summary, after you approve the method of delivery.
  • Although we endeavour to minimise import delays and taxes/duties by shipping products from a hub/factory in your economic region, this decision is the discretion of our supply chain providers, who consider such criteria as manufacturing capacity and/or availability of raw materials. As the case may be, requiring importation, to fulfil your order in a reasonable amount of time. Therefore, while we make all reasonable efforts to apply all applicable taxes at checkout, you may be required to settle import duties or customs charges in addition to the amounts we charge. We cannot be held liable for such amounts.

9. Regional pricing, stock availability, accuracy of supply chain data

  • We do our utmost to ensure accurate, complete, timely information on the website. Our Shop filters the products available in your region, but we cannot guarantee such availability.
  • If we are unable to supply items in the quantity agreed at checkout, you may request a refund or a discount coupon for a new purchase, as you prefer. For all items in your purchase, you agree to make payment, even if such payment is not collected at checkout, due to a system fault, or any interruption in checkout.
  • You agree to make payments via the method of payment you select in checkout.
  • Our systems will charge your means of payment in the currency you've chosen via our Store Currency page. Our payments provider (PCI compliant, Level 1) converts the checkout total to your bank currency, as necessary.
  • Any refunds will be in the currency amount (i.e. regional price) as quoted at checkout. Should the currency of your bank account differ to the checkout currency, we cannot accept liability for any discrepancy between the amount charged and refunded, due to exchange rate variance, at time of refund.

  • You understand that all elements of the site constitute intellectual property. Which may be protected by copyright, trademark and/or design rights.   • The site and its content shall remain the exclusive property of Groovy and/or our trading partners, as the case may be. We reserve the right to add, remove, or modify content and/or software, at any time.
  • You may download, view and utilise content from the website, only for private and non-commercial purposes. You agree not to reproduce, duplicate, copy, convert, sell or exploit any portion of the site.
  • We do our utmost to ensure a secure, enjoyable experience on our site. However we accept no liability for interference, whether by third parties or otherwise, intentional or accidental, which may impact your experience of our service.
  • You hereby agree to engage with our service in a professional manner. Including, but not limited to respecting the integrity of our backend services ("API" functions) or third party APIs we provide in our service to you.
  • We may transfer our rights under this agreement without prior notification.

  • All content on this website is expressing our opinion. Including but not limited to product designs, blog articles, site pages, third party content, or tools.
